ZORA Terms of Service
ZORA is a brand of LIBERTY COMPLIANCE, INC., located at 6008 Lansdowne Avenue, Philadelphia, PA 19151 ("we," "us," or "our"). By accessing or using the ZORA application and any related services (collectively, "the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
1. Who May Use ZORA
ZORA is designed for use by children under the direct supervision of a parent or legal guardian. By creating an account, you represent that you are at least 18 years of age and are the parent or legal guardian of any child whose profile you create within the Service. You accept full responsibility for ensuring your child's use of ZORA complies with these Terms.
2. Accounts and Profiles
You are responsible for maintaining the confidentiality of your account credentials and your parent PIN. You are responsible for all activity that occurs under your account. You agree to notify us immediately at hello@zoravillage.com if you suspect unauthorized access to your account. We reserve the right to suspend or terminate accounts that violate these Terms.
3. Subscriptions and Payments
ZORA offers a permanently free tier and optional paid subscription tiers ("Village Pass," "Family Village," and "School Village") billed through Paddle.com, our authorized merchant of record. Paddle handles all payment processing, tax collection, and billing on our behalf. By purchasing a subscription, you agree to Paddle's terms of service in addition to these Terms. All prices are listed in US dollars unless otherwise stated at checkout.
4. Refunds and Cancellations
All refund requests are governed by our Refund Policy, available at zoravillage.com/refund. You may cancel your subscription at any time through the "Your Village" section of the Parent Portal or through Paddle's customer portal. Upon cancellation, you retain full access to your paid tier until the end of your current billing period. No partial refunds are issued for unused time within a billing period except as required by applicable law or as described in our Refund Policy.
5. Children's Privacy and COPPA Compliance
ZORA is committed to protecting the privacy of children. We do not knowingly collect personal information directly from children under the age of 13. All account creation and data management is performed by the parent or legal guardian.
The "Create Your Own Anthem" voice recording feature, which involves the collection of a child's voice — classified as personal information and potentially as biometric data under applicable law including COPPA — is disabled by default for all accounts. This feature may only be activated by a parent or legal guardian through a verified, high-level parental consent mechanism, which may include a credit card transaction confirmation or government-issued identification verification, as required by the FTC's COPPA Rule. We do not activate microphone access for any child profile without this verified parental consent. Our full data practices are described in our Privacy Notice at zoravillage.com/privacy.
6. Educational Outcomes Disclaimer
ZORA is designed based on pedagogical research, including the Science of Reading and evidence-based phonics instruction methodologies. However, WE MAKE NO GUARANTEES REGARDING SPECIFIC EDUCATIONAL OUTCOMES, LITERACY MILESTONES, OR READING PROFICIENCY LEVELS WITHIN ANY SPECIFIC TIMEFRAME. Individual results will vary based on frequency of use, the child's developmental stage, and factors outside our control. ZORA is a supplemental educational tool and is not a substitute for professional instruction, evaluation, or intervention.
7. Intellectual Property
All content within ZORA — including but not limited to the Village Map, character illustrations, phonics curriculum, Anthem audio tracks, and the ZORA name and Circle Z logo — is the intellectual property of LIBERTY COMPLIANCE, INC. and is protected by applicable copyright and trademark law. You may not reproduce, distribute, modify, or create derivative works from any ZORA content without our prior written consent.
8. User-Generated Content
If ZORA enables any feature through which you or your child may submit content (including but not limited to custom Anthem recordings activated through verified parental consent), you grant LIBERTY COMPLIANCE, INC. a non-exclusive, royalty-free, worldwide license to use, store, and display that content solely for the purpose of operating and improving the Service. We do not sell user-generated content to third parties.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
THIRD-PARTY RELIANCE: ZORA relies on third-party infrastructure, including but not limited to Paddle.com for billing and subscription management and Supabase for data storage and authentication. We are not liable for any service interruptions, data breaches, billing errors, or failures occurring solely within these third-party environments. Your use of these third-party services is governed by their respective terms of service and privacy policies.
FORCE MAJEURE: We shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to acts of God, war, riot, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, service outages resulting from equipment or software failure, or telecommunications failures.
10. Limitation of Liability
To the fullest extent permitted by applicable law, LIBERTY COMPLIANCE, INC. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
11. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions. Any dispute arising from these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may seek injunctive relief in a court of competent jurisdiction in Philadelphia, Pennsylvania for matters involving intellectual property or confidentiality.
CLASS ACTION WAIVER: TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU EXPLICITLY WAIVE ANY RIGHT TO SERVE AS A REPRESENTATIVE, AS A PRIVATE ATTORNEY GENERAL, OR IN ANY OTHER REPRESENTATIVE CAPACITY, OR TO PARTICIPATE AS A MEMBER OF A CLASS OF CLAIMANTS IN ANY LAWSUIT, ARBITRATION, OR PROCEEDING FILED AGAINST LIBERTY COMPLIANCE, INC.. IF THIS CLASS ACTION WAIVER IS FOUND TO BE UNENFORCEABLE, THEN THE ENTIRETY OF THE ARBITRATION AGREEMENT IN THIS SECTION SHALL BE NULL AND VOID.
12. Changes to These Terms
We may update these Terms at any time. We will notify you of material changes by email or by a prominent notice within the app at least 14 days before the changes take effect. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
13. Indemnification
YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS LIBERTY COMPLIANCE, INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS FROM AND AGAINST ANY AND ALL CLAIMS, LIABILITIES, DAMAGES, LOSSES, OR EXPENSES, INCLUDING REASONABLE ATTORNEYS' FEES AND COSTS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH (I) YOUR ACCESS TO OR USE OF THE SERVICE; (II) YOUR VIOLATION OF THESE TERMS; OR (III) ANY INFRINGEMENT BY YOU, OR ANY THIRD PARTY USING YOUR ACCOUNT, OF ANY INTELLECTUAL PROPERTY OR OTHER RIGHT OF ANY PERSON OR ENTITY.
